Please read these Terms of Service carefully before using milehighcook.net or engaging MileHighCook for private chef, catering, meal prep, or any related culinary services. By accessing our website or booking services, you agree to be bound by these Terms. These Terms apply to all services provided across Colorado, Arizona, Utah, and Wyoming and supplement — but do not replace — your individual signed service agreement.

Quick summary: All MileHighCook bookings are all-inclusive and all-transparent. One price covers everything — groceries, labor, cooking, service, and cleanup. No gratuity, and no fee you haven’t seen: if a card processing fee applies to your booking it is itemized on your proposal and invoice before you pay, and paying by Zelle avoids it. A 50% deposit holds your date and is fully refundable until 30 days before your event; bookings made inside 30 days are paid in full up front. Within 30 days of your event, cancellations are not accepted and all payments are final. Full details below.

1. Services

Mountain Chef Concepts LLC, a Colorado limited liability company doing business as MileHighCook ("Company," "we," "us") provides private chef, catering, meal prep, corporate event, and related culinary services. All services are subject to availability. A formal written proposal and signed Client Services Agreement between MileHighCook and the client ("Client") is required prior to any event. These Terms supplement that agreement — in the event of a conflict, the signed agreement controls.

2. Bookings, Deposits and Payment

A deposit equal to fifty percent (50%) of the total service fee is required to reserve your event date. The deposit is fully refundable if you cancel thirty (30) or more calendar days before the event. The remaining balance is due no later than seven (7) calendar days before the event.

If your event date falls within thirty (30) calendar days of booking, the full service fee is due in full upon signing to reserve the date, and no separate balance payment applies.

Proposed dates are held for seventy-two (72) hours after a proposal is issued. If no deposit is received within that window, the date is released and availability is not guaranteed. All payments are final and non-refundable except as expressly stated in the Cancellations and Rescheduling section below.

Sales tax. Applicable state and local sales tax is calculated on your proposal and shown before you pay. Clients holding a valid tax exemption must provide their certificate before the proposal is issued.

Payment methods and card fees. We accept payment by card or by Zelle. Where a card processing fee applies it is four percent (4%) of the amount charged, shown as its own line on your proposal and invoice before any payment is taken, and included in the total you approve. Zelle payments carry no processing fee. We never add a fee after the fact.

No changes to the event date, menu, guest count, services, or venue may be made within fourteen (14) calendar days of the event. Late change requests may be refused or subject to additional fees at MileHighCook's sole discretion.

Weekly meal prep works differently. Recurring meal-prep service has no event date, no deposit and no balance, and Sections 2 and 3 of these Terms do not apply to it. Labor is billed at $75 per hour plus applicable sales tax. The first week carries a minimum of six (6) hours ($450), paid before the first service; after that, hours are purchased in blocks of twenty-four (24) hours ($1,800). Block hours belong to you — they are not tied to a set number of hours per week, they roll forward, and they do not expire while the service continues. Groceries are passed through at actual cost with no markup. You may skip any week with at least 72 hours’ notice before that week’s Monday and nothing is forfeited; without that notice, the hours reserved for that week come out of your block. Either party may end the service on the same notice: hours already worked are charged in full, and any unused block hours are refunded at $75 per hour. Your signed meal-prep agreement governs in full.

3. Cancellations and Rescheduling

Cancellations 30 or more days before the event: All amounts paid, including the deposit, will be refunded in full within 14 business days.

Cancellations fewer than 30 days before the event: Cancellations are not accepted. The Client is responsible for 100% of the total service fee, including all labor and perishable materials, and no payments will be refunded, including amounts prepaid in full.

Rescheduling: A one-time reschedule is permitted if requested at least 14 calendar days before the original event date, the new date falls within 90 calendar days of the original, and Company availability permits. The original deposit will be applied to the rescheduled date. Reschedule requests made fewer than 14 days out are treated as cancellations. All cancellations must be submitted in writing to be valid.

4. All-Inclusive Pricing and Gratuity

All MileHighCook proposals are fully all-inclusive. The quoted price covers: chef fees and all labor, grocery shopping and ingredients, preparation, cooking, and plating, professional table service, and complete post-event cleanup. There are no hidden fees and no gratuity is expected or required — no fee is ever charged that was not itemized on your proposal before you paid. The price in your signed agreement is the final price, subject only to scope changes you request.

Travel. No separate travel fee is charged for events inside the markets we publish. Where an event location sits materially outside those markets, any travel or lodging cost is quoted as its own line on your proposal and agreed in writing before booking — it is never added afterwards.

Additional surcharges that may apply and will always be disclosed in writing before booking:

Late-night surcharge: $150/hr for service extending past 11:00 PM (billed in 30-min increments)
Access surcharge: $50 for venues with difficult access (stairs, no elevator, remote entry)
Extended event surcharge: $150/hr for events exceeding 4 hours from start time
Cleanup surcharge: $150–$300, applied only if (a) the kitchen or service area is not reasonably clear and usable when we arrive, so cleaning is required before cooking can begin, or (b) cleanup after the event goes beyond our own cooking and service — for example damage, or clearing up after guests or other vendors. We always clean the kitchen and service areas we use at no charge, and will tell you before applying this surcharge.

5. Venue Access and Client Responsibilities

Client agrees to provide a safe, functional kitchen with adequate utilities (range, oven, refrigeration, running water, counter space), ensure timely access including codes, keys, and parking, and maintain a respectful, hazard-free environment for Company personnel.

If Client provides an incorrect address or causes a delay exceeding 30 minutes, MileHighCook may cancel the event without refund or charge a $100/hr wait-time fee billed in 30-minute increments. Client is responsible for ensuring the venue permits outside catering services.

6. Food Allergies and Dietary Restrictions

Client must disclose all known food allergies, intolerances, and dietary restrictions for all guests in writing at the time of booking. MileHighCook will make reasonable efforts to accommodate disclosed needs.

However, MileHighCook operates in residential kitchen environments and cannot guarantee that any dish is completely free of allergens including nuts, gluten, dairy, shellfish, soy, or eggs. MileHighCook is not liable for any allergic reaction, adverse response, illness, or injury resulting from undisclosed allergies or cross-contamination in environments outside our control. Guests with severe allergies should exercise caution or provide their own meals. By engaging our services, Client acknowledges and accepts this limitation and agrees to inform all guests accordingly.

7. Alcohol Policy

MileHighCook does not sell alcohol or mark it up. All alcohol is either purchased directly by the Client, or sourced by MileHighCook at cost and billed to the Client with no markup. Where the Client requests it, MileHighCook may staff bartenders to serve Client-supplied alcohol; bar staff are billed as labor, separately from food service. Client is responsible for all alcohol purchasing decisions and legal compliance. MileHighCook assumes no liability for alcohol-related incidents, including service to minors or overconsumption.

8. Photography and Media

MileHighCook may photograph plated dishes, table settings, and food presentation at events for use in our portfolio, website, and marketing materials. We will not photograph guests or identifiable individuals without their express consent, and we will never post private addresses or sensitive personal information. To opt out of photography at your event, notify us in writing prior to the event date. By engaging our services, you grant MileHighCook a non-exclusive, royalty-free license to use non-identifying food and event photography for marketing and promotional purposes.

9. Professionalism and Right to Terminate

MileHighCook maintains high standards for appearance and service. Client agrees not to interfere with Company staff or operations and to treat all personnel with dignity and respect. MileHighCook reserves the right to terminate services immediately and without refund if any member of the Client's party behaves in a manner that is disruptive, unsafe, threatening, or otherwise inappropriate toward Company personnel.

10. Chargebacks and Non-Disparagement

Chargebacks: All payments are final subject to the Cancellations and Rescheduling section above. Client waives the right to initiate a chargeback without first providing MileHighCook written notice and a reasonable opportunity to resolve the issue. If a chargeback is initiated without cause, Client is liable for the full invoiced amount, all administrative and processing fees, collection costs and attorneys' fees, and liquidated damages of $1,500 per violation — which represents a reasonable estimate of costs and expenses, not a penalty.

Non-disparagement: Client agrees not to publish or assist in the publication of any false or defamatory statements — online or otherwise — about MileHighCook, its personnel, or contractors. This clause does not restrict honest, factual reviews or other communications protected by law, including the Consumer Review Fairness Act. If we give written notice identifying specific false or defamatory statements, Client will remove or correct them within five (5) business days. Violations may result in injunctive relief, monetary damages, and recovery of attorneys' fees.

11. Force Majeure

MileHighCook shall not be liable for failure or delay in performing services resulting from causes beyond our reasonable control, including acts of God, extreme weather, pandemic, government restrictions, power outages, supplier failures, or other circumstances making performance commercially impracticable. In such cases, deposits may be credited toward a rescheduled event within 90 calendar days, subject to availability.

12. Limitation of Liability

MileHighCook's total liability for any claim arising from our services shall not exceed the total amount paid for the specific event giving rise to the claim. MileHighCook is not liable for venue or equipment malfunctions, breakage of Client property during normal use, or any indirect, incidental, special, consequential, or punitive damages.

13. Indemnification

Client agrees to indemnify, defend, and hold harmless Mountain Chef Concepts LLC d/b/a MileHighCook, its members, employees, agents, and contractors from any claims, liabilities, damages, losses, or expenses — including reasonable attorneys' fees — arising out of breach of this agreement, inaccurate information provided by Client, unsafe or hazardous conditions at the venue, or any act or omission of Client or their guests. This section survives termination of this agreement.

14. Intellectual Property

All content on milehighcook.net — including text, photography, menus, graphics, logos, and branding — is the property of Mountain Chef Concepts LLC d/b/a MileHighCook and protected by applicable copyright and trademark law. Custom menus created for your event remain the intellectual property of MileHighCook. You may not reproduce or use any MileHighCook content without express written permission.

15. Dispute Resolution

Any dispute arising from these Terms or our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with proceedings in Denver County, Colorado. The party initiating arbitration bears all filing and administrative costs. The prevailing party is entitled to recover reasonable attorneys' fees and costs.

This section does not prevent MileHighCook from bringing a qualifying claim in Colorado small claims court.

16. Governing Law

These Terms are governed by the laws of the State of Colorado. Except for matters resolved through arbitration or small claims court, any legal proceedings shall be brought exclusively in the state or federal courts of Denver County, Colorado.

17. Severability and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with your signed Client Services Agreement, constitute the entire understanding between the parties. No oral statements or prior agreements are binding unless set forth in writing and signed by both parties.

18. Gift Cards

MileHighCook gift cards are prepaid credit toward our services. They are not bank products, credit cards, or stored-value instruments issued by a financial institution, and they earn no interest.

Amounts and delivery. Gift cards are available in set amounts of $250, $500 and $1,000, or any custom amount from $50 to $10,000. They are purchased through our secure Stripe checkout and delivered by email with a unique code in the format MHC-XXXX-XXXX, together with any personal message the buyer adds.

No expiration and no fees. MileHighCook gift cards never expire. There are no dormancy, inactivity, service, or maintenance fees of any kind, and no fee is ever deducted from the balance. The full face value remains available until it is used.

How to redeem. Share the code with us when you inquire or when your proposal is issued, and we apply it to your invoice. A card may be used across more than one booking: if the balance exceeds the amount owed, the remainder stays on the card for next time, and if the amount owed exceeds the balance, the difference is payable by card or Zelle in the ordinary way.

What it covers. A gift card may be applied to any amount MileHighCook invoices — any service in these Terms, in any market we serve, including applicable sales tax and any disclosed surcharge.

Applied credit counts as payment. Once a gift card is applied to a booking, the amount drawn from it is treated exactly like any other payment, and the Cancellations and Rescheduling section governs it. If you cancel thirty (30) or more calendar days before the event, the amount drawn is returned to the gift card, restoring that balance for future use. If you cancel fewer than thirty (30) days before the event, that amount is forfeited under the same cancellation policy that applies to a card or Zelle payment, and is not restored to the gift card.

No cash redemption. Gift cards are not redeemable for cash, except where applicable state law requires otherwise, in which case we follow that law.

Refunds within 30 days. The original purchaser may request a full refund within thirty (30) calendar days of purchase, provided none of the balance has been used. We refund to the original payment method, and the code is retired at the same time so it can no longer be redeemed. Once any part of the balance has been used, or once thirty days have passed, the purchase is non-refundable — the card still never expires, and it may be given to someone else.

Transfer, loss and misuse. Gift cards are freely transferable — whoever holds the code may use it, so treat it like cash. If a code is lost, contact us with proof of purchase and we will reissue the remaining balance from our records. We may void a card, without notice, that was obtained fraudulently or whose purchase payment is reversed, charged back, or otherwise not received.

Relationship to your booking. A gift card is a method of payment only. It does not reserve a date, and it does not change the deposit, balance, cancellation, or rescheduling terms in these Terms or in your signed Client Services Agreement.
